Welcome to the website of Rooted Outdoor LLC (“Rooted Outdoor,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website and your purchase or use of services provided by Rooted Outdoor LLC.

By accessing our website, requesting an estimate, scheduling services, approving a proposal, or otherwise engaging Rooted Outdoor LLC for services, you acknowledge that you have read, understood, and agreed to these Terms.

1. Services
Rooted Outdoor LLC provides residential and commercial outdoor property services, which may include, but are not limited to:
- Lawn mowing and lawn maintenance
- Landscaping and landscape maintenance
- Yard cleanups
- Bush and shrub trimming
- Tree trimming and pruning
- Light tree and outdoor property work
- Fence installation, repair, staining, and related services
- Pressure washing
- Exterior cleaning
- Junk removal and hauling
- Debris removal
- Property cleanouts
- Installation of grass, mulch, and other landscape materials
- Other outdoor property improvement and maintenance services

The specific services to be performed will be identified in the applicable estimate, proposal, work order, invoice, or service agreement.

Rooted Outdoor LLC reserves the right to decline work that it determines to be unsafe, outside its capabilities, outside the agreed scope of work, or otherwise inappropriate for the Company to perform.

2. Estimates and Proposals
Estimates and proposals provided by Rooted Outdoor LLC are based on the information reasonably available to the Company at the time the estimate is prepared.

Unless otherwise stated in writing:
- Estimates are not guarantees of a final price.
- Additional labor, materials, disposal fees, equipment costs, or unforeseen conditions may result in additional charges.
- Changes to the requested scope of work may result in a revised price.
- Hidden conditions discovered after work begins may require additional authorization and charges.

Examples of unforeseen conditions may include buried materials, concealed structural problems, excessive debris, difficult access, hazardous materials, underground obstructions, unstable structures, or conditions that were not reasonably visible during the initial estimate.

3. Scope of Work
Rooted Outdoor LLC will perform the services specifically described in the approved estimate, proposal, work order, or service agreement.

Work not specifically included in the agreed scope of work is not included in the quoted price unless otherwise agreed in writing.

Customers may request additional services. Rooted Outdoor LLC may provide a revised estimate or additional charge before performing such work.

4. Customer Responsibilities
Customers are responsible for providing Rooted Outdoor LLC with reasonable access to the property and work areas.

Customers agree to:
- Provide accurate information regarding the property and requested services.
- Identify known hazards, underground utilities, irrigation systems, septic systems, private utility lines, or other conditions that may affect the work.
- Provide access to areas where services are scheduled.
- Remove or secure personal belongings, vehicles, pets, decorations, furniture, or other items that could interfere with the work.
- Obtain any required permission from property owners, landlords, homeowners associations, or other parties when applicable.
- Ensure that the Company has access to necessary utilities when required for the agreed service.

Customers may be responsible for damage to personal property or property conditions resulting from the failure to disclose known hazards or failing to properly prepare the work area.

5. Property Access
By scheduling services, the customer authorizes Rooted Outdoor LLC and its authorized personnel to enter the agreed portions of the property for the purpose of providing the contracted services.

If the Company cannot reasonably access the property at the scheduled time, the Company may charge applicable cancellation, trip, rescheduling, or other fees that have been disclosed to the customer.

6. Pricing and Payment
Customers agree to pay the amount stated on the approved estimate, proposal, invoice, or service agreement, subject to any authorized changes or additional work.

Payment terms may vary depending on the service.

Rooted Outdoor LLC may require:
- Deposits
- Material payments
- Progress payments
- Full payment upon completion
- Payment according to recurring-service arrangements
- Other payment arrangements agreed upon in writing.

Invoices are due according to the payment terms stated on the invoice.

Late or unpaid balances may be subject to reasonable collection costs, late fees where permitted by law, and other remedies available under applicable law.

7. Deposits and Materials
When a deposit or material payment is required, the customer agrees to provide the required payment before work or material procurement begins.

Deposits may be applied toward labor, materials, equipment, disposal, scheduling, or other project-related costs.

Materials that have been ordered, purchased, delivered, or specially prepared for a customer's project may be non-refundable to the extent permitted by applicable law.

8. Changes and Cancellations
Customers should provide reasonable notice when requesting cancellation or rescheduling of services.

Rooted Outdoor LLC reserves the right to charge reasonable cancellation, mobilization, restocking, material, or scheduling fees when applicable and disclosed to the customer.

For larger projects, cancellation terms may be specified separately in the project agreement or proposal.

9. Weather and Uncontrollable Conditions
Certain services are dependent upon weather and site conditions.

Rooted Outdoor LLC may postpone or reschedule work because of:
- Rain
- Severe storms
- Lightning
- High winds
- Extreme temperatures
- Wet or unsafe ground conditions
- Flooding
- Other weather-related conditions
- Other circumstances that create an unsafe or impractical work environment

The Company will make reasonable efforts to reschedule affected services.

Rooted Outdoor LLC will not be responsible for delays caused by circumstances outside its reasonable control.

10. Landscaping and Lawn Care
For lawn care and landscaping services, results may depend on weather, soil conditions, irrigation, existing vegetation, pests, disease, prior property conditions, and other factors outside the Company's control.

Rooted Outdoor LLC does not guarantee the growth, survival, color, or appearance of grass, plants, shrubs, trees, sod, seed, or other living materials unless a separate written warranty specifically states otherwise.

Customers are responsible for providing appropriate irrigation and ongoing maintenance unless those services are specifically included in the Company's scope of work.

11. Tree Work
Tree trimming, pruning, and related services involve inherent risks.

Rooted Outdoor LLC may decline tree work that requires specialized equipment, advanced climbing, removal of dangerous trees, work near energized electrical lines, or other work that the Company determines to be unsafe or outside its capabilities.

The customer is responsible for identifying known underground utilities, irrigation systems, septic systems, or other concealed property features.

Rooted Outdoor LLC will use reasonable care while performing contracted tree services but cannot guarantee that surrounding vegetation, landscaping, structures, or property will remain completely unaffected by necessary work.

12. Fencing and Construction-Related Work
For fencing and similar projects, customers acknowledge that existing site conditions may affect installation.

These conditions may include:
- Uneven terrain
- Rock
- Concrete
- Tree roots
- Underground utilities
- Irrigation systems
- Existing structures
- Property-line issues
- Soil conditions
- Hidden obstructions

Unless specifically included in writing, Rooted Outdoor LLC is not responsible for surveying property boundaries or determining legal property lines.

Customers are responsible for ensuring that the proposed fence or improvement is permitted and located within the customer's legal property boundaries unless such services are specifically included in writing.

13. Junk Removal and Hauling
Junk removal and hauling services are subject to applicable laws, disposal requirements, weight limitations, and facility restrictions.

Rooted Outdoor LLC may refuse to transport or dispose of materials that are prohibited, hazardous, illegal, contaminated, or otherwise unsuitable for ordinary disposal.

Unless specifically agreed to in writing, prohibited materials may include hazardous chemicals, asbestos-containing materials, biohazardous materials, explosives, ammunition, radioactive materials, and other regulated substances.

The customer must disclose any known hazardous or prohibited materials before work begins.

Additional disposal, landfill, transfer-station, recycling, or special handling charges may apply when disclosed or reasonably necessary to complete the work.

14. Pressure Washing and Cleaning
Pressure washing and exterior cleaning can involve water pressure, cleaning solutions, and equipment that may affect certain surfaces.

Customers acknowledge that existing deterioration, loose paint, damaged surfaces, weak materials, improper prior repairs, oxidation, staining, or other pre-existing conditions may become visible or worsen during cleaning.

Rooted Outdoor LLC will use reasonable care and appropriate methods based on the conditions reasonably observable at the time of service.

The Company does not guarantee removal of every stain, discoloration, mold mark, algae stain, oil stain, rust stain, or other surface condition.

15. Pre-Existing Conditions
Rooted Outdoor LLC is not responsible for damage caused by pre-existing defects, deterioration, improper construction, faulty installation, weakened materials, hidden conditions, or conditions that could not reasonably be identified before work began.

Customers acknowledge that certain existing conditions may become more noticeable after cleaning, landscaping, trimming, demolition, removal, or other services.

16. Damage to Property
Rooted Outdoor LLC will use reasonable care while performing services.

If property damage is alleged to have occurred as a result of Company activities, the customer should notify Rooted Outdoor LLC as soon as reasonably possible and provide photographs and other relevant information when available.

The Company reserves the right to inspect the alleged damage before determining responsibility.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived under applicable law.

17. Safety
Rooted Outdoor LLC reserves the right to stop, postpone, or refuse work when conditions are unsafe.

Unsafe conditions may include dangerous structures, aggressive animals, exposed electrical hazards, hazardous materials, severe weather, unstable trees, unsafe working surfaces, or other conditions that could reasonably endanger customers, Company personnel, contractors, or third parties.

Additional work required to address unsafe or unforeseen conditions may require a revised estimate.

18. Subcontractors and Personnel
Rooted Outdoor LLC may use employees, independent contractors, subcontractors, vendors, or other authorized personnel to perform portions of the services when appropriate.

All personnel performing work on behalf of Rooted Outdoor LLC are expected to follow applicable Company policies and job requirements.

19. Photos and Property Documentation
Rooted Outdoor LLC may take photographs or videos of work areas for purposes including estimating, project documentation, quality control, insurance documentation, and record keeping.

The Company will not knowingly use identifiable customer information for public marketing without appropriate authorization.

20. Website Use
The information contained on this website is provided for general informational purposes.

Customers agree not to:
- Use the website for unlawful purposes.
- Attempt to interfere with website operation.
- Access restricted portions of the website without authorization.
- Copy or misuse Company content, branding, photographs, or materials.
- Submit false, misleading, or fraudulent information.

Rooted Outdoor LLC reserves the right to modify, suspend, or discontinue any portion of the website at any time.

21. Intellectual Property
The Rooted Outdoor LLC name, logo, branding, photographs, graphics, written content, website design, and other original materials are the property of Rooted Outdoor LLC or its respective licensors unless otherwise stated.

These materials may not be copied, reproduced, modified, distributed, or used for commercial purposes without written permission.

22. Third-Party Services
Rooted Outdoor LLC may use third-party services or platforms for purposes such as payment processing, scheduling, communications, mapping, website hosting, advertising, or other business functions.

Rooted Outdoor LLC is not responsible for interruptions, errors, policies, or practices of third-party services that are outside the Company's reasonable control.

23. Limitation of Liability
To the maximum extent permitted by applicable law, Rooted Outdoor LLC shall not be liable for indirect, incidental, special, consequential, or unforeseeable damages arising from the use of the website or services.

Nothing in these Terms is intended to exclude liability for matters that cannot legally be excluded or limited under applicable law.

24. Customer Complaints and Disputes
Customers are encouraged to contact Rooted Outdoor LLC promptly regarding any concern with services.

The parties agree to make a good-faith effort to resolve disputes directly before pursuing formal legal action.

Nothing in this section prevents either party from exercising rights that cannot legally be waived.

25. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Any legal action shall be subject to the applicable jurisdiction and venue requirements of Texas law.

26. Changes to These Terms
Rooted Outdoor LLC may update these Terms from time to time.

Updated Terms will become effective when posted on the website unless a different effective date is stated.

Customers should periodically review these Terms for changes.

27. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.

28. Entire Agreement
These Terms, together with any applicable estimate, proposal, work order, invoice, service agreement, or other written agreement between Rooted Outdoor LLC and the customer, constitute the agreement governing the applicable services.

If there is a conflict between these Terms and a specific written service agreement, the specific written service agreement will control for that particular project to the extent of the conflict.

29. No Waiver
A failure by Rooted Outdoor LLC to enforce any provision of these Terms shall not constitute a waiver of the Company's right to enforce that provision in the future.
